Introduction
The terms “you” and “your” refer to a consumer who submits a credit application (“application”) to obtain financing in connection with Chrysler Capital auto financing through Santander Consumer USA Inc. (“we,” “us” and “our”). By agreeing to receive information from us electronically, you will receive certain disclosures, notices, information and documents related to your Application and financing (“Documents”) electronically, which may include through our website(s), other websites related to the Application, and your email address. The Documents you receive from us electronically will include, but are not limited to, the Application, this Consent for Electronic Documents, the Consent for Sharing and Use of Information, our Privacy Policy, the Consent for SMS/Texting, the Telephone Consumer Protection Act notice and notices of our credit decision about your Application. This Consent for Electronic Documents informs you of your rights regarding receiving these Documents electronically. You will be unable to submit an Application unless you consent to receiving Documents electronically. This consent applies to the financing transaction you are requesting and all documents and records that relate to it.
Hardware and Software Requirements
Before you decide to receive the Documents electronically, you must determine if you have the necessary hardware and software described below to access and retain the Documents. To access the Documents, you will need a working email address, Adobe Acrobat Reader and a computer or other access device that can access the Internet using a web browser. To retain the Documents, the computer or access device must allow you to download and save Documents to a hard drive or external storage media, print web pages as well as embedded HTML files or both. You should save and/or print this page to be sure you have the necessary hardware and software.
Withdrawing Consent
You may withdraw your consent to receive Documents electronically at any time by contacting us via telephone at 855-563-5635. If you do, we will continue the Application and financing process in non-electronic format at no charge to you. If you decide to withdraw your consent, any Document that we previously provided to you as an electronic Document will remain valid, enforceable, sufficient for its intended purpose and unaffected by the withdrawal of your consent. If you decide to withdraw your consent for electronic Documents, you will not have the option later to receive Documents from us electronically.

If you wish to obtain a paper copy of any of the Documents, you may call us by telephone at 855-563-5635 and request a copy at no charge.

- THAT YOU CAN RECEIVE DOCUMENTS ELECTRONICALLY AND CAN ACCESS AND RETAIN THOSE DOCUMENTS;
- THAT YOU CAN RECEIVE AND READ EMAIL MESSAGES SENT TO THE EMAIL ADDRESS IN YOUR APPLICATION;
- THAT YOU CAN ACCESS INFORMATION PROVIDED ELECTRONICALLY AT OUR WEB SITE AND OTHER WEB SITES RELATED TO YOUR APPLICATION;
- TO RECEIVE DOCUMENTS ELECTRONICALLY AND TO STORE OR PRINT THOSE DOCUMENTS FOR YOUR RECORDS;
- THAT THE ACTIONS DESCRIBED HERE OR ON THE DOCUMENTS WILL SERVE AS YOUR ELECTRONIC SIGNATURE ON ANY SUCH DOCUMENTS.

Fair Lending
Chrysler Capital is committed to Fair Lending and treating consumers, customers and vendors with the utmost respect and fairness. Under the Equal Credit Opportunity Act (ECOA), Chrysler Capital is prohibited from discriminating in any aspect of the credit transaction. Prohibited bases are: sex, marital status, race, color, religion, national origin, age (provided the applicant is of legal age), income derived from public assistance and the fact that the applicant has—in good faith—exercised any right under the Consumer Protection Act (i.e. the right to lodge a complaint). Telephone Consumer Protection Act
To ensure that consumer’s inquiries are handled promptly, courteously, and accurately, some of the phone calls between you and us or any of our affiliates, agents, assigns and service providers, may be monitored and recorded by us and any of our affiliates, agents, assigns and service providers, to enhance service to you. You consent to this monitoring and recording.
You agree that, in order for us to service this contract or to collect any amounts you owe, that Chrysler Capital may from time to time make calls and/or send text messages to you at any telephone number associated with my account, including wireless telephone numbers that could result in charges to you. The manner in which these calls or text messages are made to you may include, but is not limited to, the use of prerecorded/artificial voice messages and/or automatic telephone dialing system. You further agree that in order for us to service this contract or to collect any amounts you owe, that Chrysler Capital may send e-mails to you at any e-mail address you provide us or use other electronic means of communication to the extent permitted by law.
Consent for SMS/Texting
If a mobile number is provided, we may text you information about your application. ChryslerCapital.com does not charge to send or receive text messages as part of our application process. However, messages and data rates may apply. Please consult with your wireless carrier for applicable text messaging fees.
Once your mobile device has been activated, you may reply STOP to ChryslerCapital.com (60379) to opt-out of the service or call 855-563-5635. We will only send you updates on the status of your application. To request additional information, text HELP to the message you receive or contact us by telephone at 855-563-5635.

We may modify or terminate our text messaging services from time to time, for any reason and without notice, including the right to terminate text messaging without notice, without liability to you, any other user or a third party. We reserve the right to modify these Terms of Use from time to time without notice. Please review these Terms of Use from time to time so that you are timely notified of any changes.
Additionally, you agree that we may send any SMS Statement Notifications through your communication service provider in order to deliver them to you. You agree to provide a valid mobile phone number for these services. You further agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, cost and expenses (including reasonable attorneys’ fee) arising from your provision of a mobile phone number that is not your own or your violation of applicable federal, state or local law, regulation or ordinance. You obligation under this paragraph shall survive termination of the Agreement, SMS Statement Notification are provided for your convenience only.
Terms of Submitting Application
The terms “you” and “your” refer to each consumer applying for Chrysler Capital auto financing through Santander Consumer USA Inc. (“we,” “us,” and “our”).
Important information about procedures for opening
a new account
To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify and record information that identifies each person who opens an account. What this means for you: when you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.
You understand that Chrysler Capital financing is available only through participating dealers. If you are preapproved, you must contact a dealer to complete the financing transaction. We will share your application with the dealer selected. Our preapproval, however, may be used at any participating dealer (please see our website for more participating dealers). Our preapproval may be affected by the vehicle you select (e.g., vehicle age and mileage), any trade-in vehicle, the amount of your cash down payment and your creditworthiness.
You understand that this is an application for a preapproval of financing and that it may not provide sufficient information to make a final credit decision. Any preapproval is subject to final credit approval, factors that are not available at the time of the online credit application and verification of identity and all information provided.
By clicking the “Apply Securely Now” button, you certify to the truth and completeness of the information provided and that you are at least 18 years of age. You agree that we (and the dealer) may obtain credit reports about you to process your application and for legitimate purposes related to any Chrysler Capital auto financing you might receive (such as reviewing, collecting and servicing the financing). Upon your request, we will inform you whether we requested a credit report and provide the name and address of the consumer-reporting agency that furnished the report. You also agree that we may verify your employment, income and any other relevant information related to your application and that we will retain the application whether or not financing is extended. You understand that a preapproval of Chrysler Capital auto financing may only be available for preapproved applicants who purchase automobiles from the inventory of participating dealers.

State Law Disclosures
The terms “you” and “your” refer to a consumer who submits a credit application (“application”)
to obtain financing in connection with Chrysler Capital auto financing through Santander Consumer USA Inc. (“we,””us,” and “our”). You will be unable to submit an application unless you consent to the state disclosures listed below. This consent applies to the financing transaction you are requesting and all documents and records that relate to it.
Married Applicants residing in a Community Property State (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, or Wisconsin): Please provide the information about your spouse requested in the Co-applicant/Spouse section, even if you spouse is not a co-applicant. Your spouse does not have to be a co-applicant unless he/she wants to be a co-applicant.
California Residents: An applicant, if married, may apply for a separate account.
Maine Residents: You must have physical damage insurance covering loss or damage to the vehicle for the term of any contract. For a lease, you must also have the liability insurance as described in the lease. You may buy this insurance from anyone you choose. You do not have to buy it from someone affiliated with the dealer or an assignee of this contract. Your choice of insurance will not affect the credit approval process unless the insurance does not satisfy the contract requirements or the insurance company does not satisfy the reasonable standards of the dealer or an assignee of the contract.
New York Residents: Consumer reports may be requested in connection with this application. Additional consumer reports may be requested with respect to any , update, or renewal of this obligation. Upon request, you will be informed whether or not a consumer report was requested and, if it was, of the name and address of the consumer reporting agency that furnished the report.
Rhode Island Residents: Credit reports may be obtained in connection with your application.
Ohio Residents: Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.
Vermont Residents: If an account is created, I authorize the obtaining of credit reports for purposes of reviewing or taking collection action on the account, or for other legitimate purposes associated with the account.
Married Wisconsin Residents: Wisconsin law provides that no provision of a marital property agreement, unilateral statement under Section 766.59, Wisconsin Statutes, or a court decree under Section 766.70, Wisconsin Statutes, affecting marital property adversely affects the interest of a creditor, unless the creditor
receives a copy of the agreement, statement or decree prior to granting the credit or unless the creditor has actual knowledge of the adverse provision when the obligation to the creditor is incurred.
